Between whom this agreement runs
These terms form the agreement between Apka Order Numainda ("we", "us") and the business using the service ("you", "the merchant"). They take effect the moment you ask us to open an account, push your first message through us, or settle an invoice. If you agree on a company's behalf, you confirm you may bind it. Where a separate signed agreement exists between us, that document prevails wherever the two differ. If any part of this does not suit your business, say so before we go live rather than afterwards.
What we provide
We staff your shop's WhatsApp line. That means replying to what your customers ask, verifying cash-on-delivery orders before anything ships, sending order and delivery news, and handing back to you anything we cannot answer. The service runs on the official WhatsApp Business Platform (Meta Cloud API). We draft your templates and file them with Meta, we supply the wording for the checkout tick box, and we connect to wherever your orders arrive so the updates we send match real ones. We are a service provider — not a courier, not a payment processor, not a seller: we write about your orders, we do not fulfil them.
We stand apart from Meta
Apka Order Numainda is an independent Pakistani business. We hold no affiliation, partnership, sponsorship, endorsement or agency with WhatsApp, Meta Platforms or Facebook. "WhatsApp" and "Meta" are their trademarks, used here only to name the platform the service runs on. Your use of WhatsApp also falls under Meta's own terms and policies, which Meta may alter whenever it wishes, and which we cannot change on your behalf.
Permission is not up for discussion
This is the clause we hold hardest, because it guards your number as much as your buyers. You may pass us contact details only for people who actively agreed at your checkout, by ticking a box that was empty until they touched it, naming your shop and stating that help and order news arrive on WhatsApp. Keep proof of that agreement and produce it if we or Meta ask. Do not supply bought lists, harvested numbers, contacts carried over from another platform, or buyers from before the tick box existed. If we find numbers added without permission, sending stops that moment and this agreement may end without notice. No exception is made for a large account.
What we will not do
The following sit outside the service and we refuse them whatever the fee: pushing promotional or discount campaigns down the support channel; writing to anyone who never agreed or who has sent STOP; dressing marketing up as an order update; posing as another business, a courier, a bank or a government body; sending anything unlawful, deceptive, hateful, adult, or promoting prohibited goods; using the service to collect data for a purpose your customers were never told about; or trying to work around Meta's rate limits, quality ratings or template review. A request of that kind can end the agreement on the spot.
Template approval rests with Meta
Every message sent on your behalf uses a template Meta cleared beforehand. We write the wording, file it, and rewrite whatever comes back refused. Approval, timing and category are Meta's to decide, and it may pause or reject a template at any moment for reasons it does not always give. We cannot promise approval, nor how quickly it arrives. Do not ask us to send anything differing from what was approved.
Your account
Keep your login details to yourself and tell us quickly if you suspect somebody else has them. Whatever happens through your account is your responsibility, your staff included. Give us correct business details and keep them fresh — a stale number or address on the account can stall template approval and, at worst, trigger a suspension we cannot appeal on your behalf.
Charges and billing
Fees, the billing cycle and any per-message cost are stated in your quotation or order form. Meta bills separately for conversations on the WhatsApp Business Platform, and those charges pass through to you at cost. Invoices fall due within the period printed on them. Where an invoice goes unpaid we may suspend sending after notice; suspension does not wipe the balance. Prices may change on thirty days' written notice, giving you room to leave if the new figure does not suit.
Where the law puts responsibility
As the merchant you are the data controller for your customers' information, and you carry responsibility for the accuracy of what you sell, the delivery and returns you promise, your own privacy notice, and compliance with Pakistani consumer and data protection law. We act as processor on your instructions. You agree to indemnify us against claims arising from your products, your delivery promises, or contact details handed to us without valid permission.
Uptime and changes
We intend to keep the service running without pause, but offer no uptime guarantee unless one is written into a separate agreement with you. Maintenance, incidents at Meta, network faults and events beyond our reach can interrupt delivery. We may improve, alter or withdraw parts of the service; where a change materially reduces what you get, reasonable notice will be given.
Our work not promise
We do not promise that your number will never be restricted, that your quality rating will hold, that a template will clear, that a message will be delivered or read, or that your sales or returns will shift by any figure. Those outcomes rest with Meta, with your buyers, and with your own products and service. Anyone in this trade claiming otherwise is selling what they cannot supply. Our work commit to is a compliant setup, honest sending practice, and a straight answer the day something goes wrong.
Limits on liability
So far as the law permits, neither side is liable for indirect or consequential loss, including lost profit, lost sales, lost data or damage to reputation. Our total liability on any claim arising from the service is capped at the fees you paid us across the three months immediately before whatever caused it. Nothing here caps liability for fraud, wilful misconduct, or anything the law does not allow to be capped.
Bringing it to an end
Either side may close this agreement on thirty days' written notice. We may suspend or end it at once where the permission rules are broken, where the service is used for anything forbidden above, where an invoice stays unpaid after notice, or where Meta withdraws access. On termination sending stops, you settle whatever is outstanding, and your data is handled as set out in our Privacy Policy. You may request an export of your conversation records before deletion; ask inside thirty days of termination.
Governing law, and how to reach us
These terms fall under the laws of Pakistan, and the courts of Karachi hold exclusive jurisdiction. Messaging rules, in brief
Set out plainly, because this is the part that matters most: we write only to people who ticked an unticked box on your checkout; every send uses a template Meta cleared in advance; STOP takes a number off instantly and permanently for that shop; we send help and order news, never marketing campaigns or cold outreach; we accept no bought, harvested or imported contact lists; and we stand independent of WhatsApp, Meta and Facebook. Breaking these is the quickest route to losing a WhatsApp number, which is why they are conditions of service and not suggestions.
